G20 Still To Agree On Treatment On Tax Havens: Diplomats

Dow Jones Deutschland – Leaders from the Group of 20 largest economies have yet to agree on how to deal with tax havens, including whether to spell out sanctions on financial centers that don’t share information.

An official at a G20 delegation said there will be "strong language" on tax havens, making it clear to them they must share information or face the consequences.

However, it’s not yet clear if they will threaten specific sanctions.

European Commission Looking For Commentary From Hedge Funds

West Palm Beach (HedgeCo.net) – In an effort to makes major changes to the EU financial regulation services, the European Commission (EC) has launched ‘Driving European Recovery’, a consultation  on major structural changes to European financial services and markets regulation.

The EC are looking for investors such as hedge funds and other interested parties to interview and submit comments before April 10th, when the EC intends to publish its proposals on the future of the EU supervisory architecture.

The Commission endorses the key principles set out in the recent de Larosière report and calls for a supervisory system combining stronger oversight at EU level with maintaining a key role for national supervisors.

The Commission will propose an ambitious new reform programme, designed to deliver “responsible and reliable financial markets for the future”.

The reform program will present a supervisory framework that detects potential risks early, deals with them effectively before they have an impact, and meets the challenge of complex international financial markets.

The Commission will present a European financial supervision package before the end of May 2009, according to a statement, fill gaps where European or national regulation is insufficient or incomplete, based on a ‘safety first’ approach and  improve risk management in financial firms and align pay incentives with sustainable performance.

Among other proposals to be revealed in May, the EC will, "Ensure more effective sanctions against market wrongdoing."

Europe’s leaders for checks on hedge funds, tax havens

Economic Times – European leaders meeting in Berlin on Sunday backed oversight of the world?s financial markets and products, including hedge funds, and urged that sanctions be drawn up to punish tax havens.

A copy of the “chair’s summary” from a summit hosted by Chancellor Angela Merkel and seen by Reuters describes the situation in financial markets as “fraught” and says structural reforms and a focus on public spending are needed to emerge stronger from the global crisis.

Curb on hedge funds likely as EU leaders back reforms

Independent – European leaders backed major reform of hedge funds yesterday as part of structural changes to help the world’s financial institutions emerge stronger from the global economic crisis.

Short-selling by the secretive hedge fund industry — selling borrowed stock in the anticipation that the prices will fall — was blamed by some politicians for exacerbating the banking crisis and economic meltdown.

A copy of the summary from the summit hosted by German Chancellor Angela Merkel in Berlin said banks should bring in reforms to ensure they build up a buffer of resources in good times and called for sanctions against tax havens.

Case Dismissed Against SAC Hedge Fund

West Palm Beach (HedgeCo.net) – Federal Judge Stanley R. Chesler of the Federal District Court of New Jersey, Friday threw out a Canadian pharmaceutical company shareholder lawsuit against a group of hedge funds including SAC Capital Advisors LP.

The Judge dismissed the lawsuit, saying "The conduct is so egregious, and the futility of imposing alternate sanctions is so clear, that dismissal is the only appropriate sanction."

Apparently the shareholders had violated a New York judge’s order sealing documents in a related Biovail case.

"The record before the court suggests that these proceedings and the RICO action proceedings were all part of a choreographed strategy by Biovail and its attorneys designed to constitute a counterattack against the Biovail securities action," the Judge wrote.

"We are gratified that the court has seen through this charade and has dismissed the case," A spokesman for SAC said.
