SEC seeking Nadel papers

Herald Tribune – The U.S. Securities and Exchange Commission is pressuring a Sarasota attorney to hand over documents for property deals tied to hedge fund manager Arthur G. Nadel and others.

Attorney R. Craig Harrison will seek a protective order today from a federal judge that would spare him from complying with the SEC.

Court-appointed receiver Burton Wiand has subpoenaed Harrison to release documents on the purchase or sale of real estate involving Nadel, hedge fund partners Neil and Christopher Moody and their funds and management companies.

Wiand also wants any documents involving Nadel’s wife, Peg Nadel, her son Geoff Quisenberry and any companies Arthur Nadel owns, such as the Venice Jet Center and a development in North Carolina.

Harrison argues that any such documents are protected by attorney-client privilege. He also says Wiand did not prove that any real estate transaction involved a "crime or fraud," which would be an exception to the attorney-client privilege.
